The Point Clear Board of Governors have adopted the following rules and regulations to help provide for the safety of pool users, to promote a family atmosphere at the pool, and to ensure the peaceful use and enjoyment of the pool by all Point Clear owners, residents, and guests. The right and obligation to enforce the rules and regulations lies with both the Board of Governors as well all owners and residents of Point Clear.
THE USE OF THE POOL AND LOUNGE AREA is limited by Point Clear’s covenants to the following: 1. Owners who have not assigned their use of the pool to their tenant. 2. Tenants who have been assigned in writing their owner’s use of the pool. 3. A family member of an owner who has been assigned in writing the use of the pool. 4. Legitimate guests of the above. 5. Owner or tenant must accompany guest(s).
Note: An owner may rent his unit with or without assigning his use of the pool to his tenant. If an owner assigns their right to use the pool to a tenant or family member, they are then ineligible to use the pool. Pool privileges are automatically suspended for any unit that is delinquent in paying any monthly assessments, special assessments, late fee, collection fees, legal fee, and/or interest until such time as all delinquent amounts are paid in full. A person whose pool privileges have been suspended may not be the guest of another unit. Any person who enters the pool area while his or her pool privileges have been suspended is subject to arrest and prosecution for trespassing and any guest(s) with them.
POOL HOURS 1. The pool is open from 8 a.m. until 10 p.m. Sunday – Thursday 2. The pool is open from 8 a.m. until 10:30 p.m. Friday & Saturday 3. The pool is open from sunrise until 8 a.m. for lap swimming only. 4. Unauthorized use of the pool and pool area after hours constitutes trespassing and may result in suspension of pool privileges and/or fines and/or arrest and criminal prosecution.
POOL GATE AND ADMITTANCE Owners and residents are not permitted to open the pool gate or hold the pool gate open for another person trying to enter the pool area, unless the person attempting to enter is a member of the owner’s or resident’s household or is his guest. For security reasons, it is Point Clear’s policy that every owner and resident must use their key to gain entrance to the pool area for their family and guests. No one is allowed to climb the fence surrounding the pool area. If an owner or resident forgets his pool key, he must get it to enter the pool area. If an owner or resident loses his key, it should be reported to a board member so that a replacement key can be purchased. The cost of this key will be assessed to the owner or resident. The pool gate is not to be propped open at any time. Please help in preventing young children from wandering alone into a potentially deadly situation. Anyone propping the pool gate open will have their pool privileges suspended for 30 days and be fined $300.
GUESTS Each unit is allowed a maximum of 3 (three) guests. Owners and residents are responsible for their guests’ behavior. It is the responsibility of the owner or resident to ensure their guests understand and abide by the Swimming Pool Rules. The owner or resident bears the penalty for any rule violations by his or her guests. Further, any guest violating the rules may be banned from Point Clear common property.
Children’s Parties: Upon application to the board and payment of a $5 fee per guest, owners who are the parents or grandparents of a child 16 years of age or younger may not more than twice per year host a child’s birthday and other type of child’s party for up to ten guests. The parties may be held during operational pool hours anytime on a non-holiday Monday – Friday and prior to 1 p.m. on a non-holiday Saturday.
Family Events: Upon application to the board, owners may (up to 2 (two) times per year) host up to six out- of-town overnight family guests at the pool. Owners must receive written board approval prior to hosting such event.
ZERO TOLERANCE POLICY Point Clear’s swimming pool is a family-oriented facility. Any activity that interferes with the peaceful use and enjoyment of the pool and the pool area by others and/or the safety of others is strictly forbidden. To that end, Point Clear has established a ZERO TOLERANCE POLICY for the below offenses: 1. Intoxication, public drunkenness, and/or drunken behavior 2. Vulgar, profane, foul, abusive, and/or sexually-oriented language 3. Sexual and/or lewd behavior 4. Disorderly Conduct, as defined by Mississippi Code Section 97-35-3 5. Disturbing the Peace, as defined by Mississippi Code Section 97-35-15 6. Glass bottles, drinking glasses made of glass, and glass containers are not permitted in the pool area. The penalty for Zero Tolerance Offenses 1 - 5 is an automatic and immediate 30-day suspension of pool privileges and a $150 fine, with said penalty being enhanced to a 60-day suspension and a $300 fine if a child is present during the violation. The penalty for item number 6 is an automatic and immediate 60 day suspension of pool privileges, and fines up to $1,000.
If any person in violation of one or more of the above Zero Tolerance Rules refuses to leave the pool area immediately after being asked to do so, then law enforcement will be called to remove the person and criminal charges will be filed.
TOBACCO FREE ZONES The fenced pool area and the breezeway leading to the pool gate and clubhouse door are tobacco free zones. Per Ridgeland City Ordinance, smoking is also prohibited within 20 feet of the pool area and Clubhouse door. There is a fine of $50 for each violation.
FOOD AND BEVERAGE 1. All alcoholic beverages must be in an opaque cup or in a can concealed by a huggy. 2. Food is not permitted in the pool or within three feet of the edge of the pool. 3. Glass bottles, drinking glasses made of glass, and glass containers are not permitted within the pool area in any form or fashion. The penalty is an automatic and immediate 60 day suspension of pool privileges, and fines up to $1,000. 4. In addition to a suspension and fine, any person causing broken glass to be in the pool will be assessed the cost of draining, cleaning, and re-filling the pool. 5. Food may not be left out unattended or for an extended period of time. 6. Anyone eating at the pool is responsible for cleaning up and proper disposal of food and eating utensils. 7. Food may not be set out buffet-style for large groups of people, or cooked or prepared at the pool area without Board of Governors approval.
TRASH Beverage containers, cups, food scraps, food wrappers, food containers, eating utensils, paper products, and all other trash must be disposed of immediately after use in the trash can by the gate.
MUSIC Personal music is permitted at low audio levels so long as it does not disturb other pool users and/or residents of the immediate pool area. Please remember that your taste in music and preferred volume might differ greatly from that of another pool user.
ELECTRICAL OUTLETS Music devices, cell phones and laptops may be plugged into electrical outlets in the pool area, but should be kept away from the water for personal safety.
OTHER RULES 1. No boisterous or rough play shall be permitted in the pool or pool area. Running is prohibited in the pool area. Diving is prohibited. 2. Proper swimwear must be worn while in the pool. No cut-offs, street clothes, shoes or sandals are allowed in the pool. 3. No sitting, standing or hanging on the granite ledge on the south side of the swimming pool. 4. All persons using the pool swimming pool do so at their own risk. The Association is not responsible for any accident or injury in connection with the use of the pool or for any loss or damage to personal property. All persons using the pool agree not to hold the Association liable for any actions of whatever nature occurring within the pool area. 5. Children twelve-years-old and under must be accompanied at all times by an adult while in the pool area. 6. Children twelve-years-old and under must have direct adult supervision to be on the lower deck of the pool area. 7. Residents and their guests are responsible for the careful observation of all safety and sanitary precautions. Any person having an apparent or known skin disease, sore or inflamed eyes(s), cough, cold, nasal or ear discharge, or any other communicable disease shall be excluded from the pool. 8. The pool shall be used in accordance with the rules and regulations as shall, from time to time, be promulgated by the State Board of Health and/or the Point Clear Board of Governors.
9. Pets are not allowed in the pool area. *Service Dogs wearing a working vest are exempt. *Please note Point Clear reserves the right to ask for Physician Certification of need, and service animal certification of training.
